Working or staying long-term in Thailand: match your visa, stay and work permit

Choose Non-B employment, DTV, BOI LTR or family/retirement residence; keep actual stay, employer, work permission and tax calendars separate.

Planning to work or spend many months in Thailand? You need to solve three independent questions: (1) which visa lets you apply to enter, (2) what permission keeps you legally in Thailand, and (3) what actual work—if any—you are allowed to perform. Buying property, receiving overseas income, marrying a Thai citizen or holding a long-stay visa does not automatically provide all three.

Find your real situation first

What you will doWhich route deserves examination
Work for a Thai companyNormally an appropriate Non-Immigrant B or other applicable status, employer documents and separate work authorisation via DOE
Work remotely for an overseas companyCheck DTV eligibility or qualifying BOI LTR Work-from-Thailand Professional, including genuine contract/activity restrictions
Work at a BOI-promoted Thai employerCheck special BOI/One Stop arrangements for the actual company and worker
Retire without workingCheck the relevant age/funds/insurance rules for the retirement route; stay does not become work permission
Live with a Thai spouse or qualifying familyCheck family/Non-O or Immigration-extension evidence and independent work-permit eligibility
Study or investEstablish the actual permission/activity limits; school admission or shareholder status is not automatic work rights

1. Local employment: agree on the legal order before the first day

Ask the employer and HR to confirm the exact legal employing entity, job location/duties, appropriate Non-Immigrant entry/status route, work-permit filing responsibility, expected first lawful paid-work date and who manages renewals.

The Department of Employment's e-WorkPermit portal lists distinct statutory processes, including Section 59 knowledge/skills employment using form บต.25, employer filings for people outside Thailand and other named job categories. An online submission is not an issued work permit, and one employer's authorisation does not become permission to work for a different company.

Illustrative scenario: A new employer says, "Come next Monday as a tourist; we'll submit your paperwork after your first shift." The safe next step is to ask for actual authorisation covering those duties and the legal start date before performing paid work. A contract and visa application receipt do not fix an unlawful first day.

2. Overseas remote employment: avoid the catch-all digital-nomad label

Thailand's Destination Thailand Visa (DTV) and BOI Long-Term Resident Work-from-Thailand Professionals have different financial, employer/qualifications and activity tests. A long stay or remote income is not proof either is available, and permission to work remotely for a foreign company must not be confused with a general Thai local-work permit.

For LTR, the BOI's official FAQ explains Work-from-Thailand Professionals cannot simply do part-time paid local Thai-company work, because their category is designed for qualifying foreign employment. For other specified LTR categories that actually work for a Thai entity, the BOI work-permit instructions outline the digital work-permit process and a category-specific interim exception once an LTR has been issued and the permit application is processing. That special BOI exception is not a universal right for ordinary Non-B or tourist workers.

Compare eligibility in the LTR versus DTV guide before paying a consultant; use the current Thai mission's DTV document list for your application.

3. Keep three calendars, not one expiry date

Document/eventWhat it actually answers
Visa/e-VisaEntry application and use/entry conditions
Permission to stay/Immigration extensionThe date you are permitted to remain under the actual approved basis
DOE work permit/authorisationThe activities and employer for which paid work is authorised
Re-entry permit, if requiredPreservation of an otherwise valid qualifying stay extension during travel
TM.30/TM.47 where applicableAccommodation reporting and recurring 90-day reporting, separate from the permission-to-stay clock

Example: Your employer-sponsored annual extension stamp is valid on paper for another eight months, but employment ends. Do not assume you automatically retain eight months of employer-based permission; also do not assume police force an immediate physical deportation. Ask Immigration/HR about the actual effect of losing the qualifying basis, cancellation procedure and any lawful alternative. See job exit and change of employer for the detailed branches.

TDAC for international re-entry: The official Thai Immigration FAQ requires a fresh arrival declaration for each qualifying entry, including many returning foreign residents. It does not preserve a stay or replace re-entry authorisation.

4. After arrival: other systems are not your visa

Living in Thailand longer may cause Thai tax residence, employer payroll tax, bank/KYC obligations or health-insurance enrollment, but those have their own triggers. Receiving overseas salary is not an automatic exemption from Thai tax. See the specialist foreign-income remittance guide; do not treat a visa type alone as the tax decision.

Your spouse or children need their own lawful entry/stay status; a Thai spouse's marriage record alone does not extend your employer-based permission. Ask if a spouse-based family extension can be applied for while your existing stay is valid, and how financial evidence is counted. Read marriage-based stay.

For insured medical care, verify employer SSO enrollment or actual private policy independently. A work permit or residence document is not a hospital coverage certificate.

5. The document checklist to give HR or your sponsoring organisation

  • Which exact entry/stay category and employer relationship?
  • Who will submit immigration documents and the DOE/BOI work application—and which authority decides?
  • What proof must be issued before the first day of permitted activity?
  • What are the actual stay, renewal, reporting and re-entry dates?
  • If employment or family circumstances change, what legal step is due and what alternatives could apply while lawful stay remains?

Before accepting a work start date or long-stay plan, get the responsible authority and employer to confirm the route that fits your actual activities, the issued work approval, your stay-until date and any separate reporting or re-entry deadlines. Tourist entry, marriage, remote work, BOI endorsement and pending applications do not automatically grant the same rights.
